Chaos, arm-twisting gave Pelosi win

After lawmakers had devoured the last of the Kalua Pig at last Thursday night’s White House Luau, Nancy Pelosi summoned her team back to the Capitol — to ensure the climate change bill wasn’t the next thing roasted on the spit.

Pelosi and her top lieutenants would spend the next four hours whipping, cajoling, begging and browbeating undecided Democrats — and triple-checking their whip lists to decide who was a solid “yes” and who was prevaricating on the cap-and-trade legislation.

Yet no matter how many calls they made — or how many times they checked and rechecked their list — Majority Whip Jim Clyburn (D-S.C.) and Majority Leader Steny Hoyer (D-Md.) kept coming up between 12 and 20 votes short of the 216 votes needed to win.

“We didn’t have the votes — and we had to have this vote,” said a leadership aide, who spoke on condition of anonymity. “This was the big one for us. [Pelosi] staked her prestige on this one. ... This was her flagship issue, and this was a flagship vote for us.”

The American Clean Energy and Security Act of 2009 passed by only 219-212, after an epic day replete with Republican ambushes, petty betrayals, hastily rearranged flights and disappearing acts.

Yet for all the apparent chaos, the action was commanded by a House speaker maneuvering with the urgency of someone who knew her reputation was on the line.

Despite Republican promises to punish battleground state Democrats for supporting a “cap and tax” plan, Pelosi and her fractious caucus passed their most serious test to date.

And whatever the fallout, aides say that both Pelosi and President Barack Obama now know that their majority can hold together — barely — when placed under withering pressure — which may bode well for the equally arduous trials on health care reform.

At the end of it all, Pelosi, who floated in and out of the House cloakroom all day, impossible to miss in an arctic-white linen pantsuit, gambled big and pulled off one of the most important legislative victories of her career, a win she views as a personal vindication, according to those close to the San Francisco Democrat.

“There’s no question about it,” Clyburn said after the vote. “She went back to her whipping days of old. She is an incredibly good whip. I’m trying to learn from her every day.”

Despite the most coordinated push yet between Democrats on the Hill and the Obama White House, the outcome was not certain until the very end, according to two dozen aides and members of Congress interviewed by POLITICO.

“It was really never a solid [216],” one person said afterward.

Party leaders agreed to bring the bill to the floor during a meeting Monday night, even though some of the members present had reservations about forcing vulnerable Democrats to cast votes on a package that may not go anywhere in the Senate.

In the days leading up the vote, the number of Democratic “yes” votes was locked at 200, according to people familiar with the tally. Every time they’d pick up one vote, another would slip. Democratic leaders needed a cushion to help protect the most vulnerable among them, and they didn’t have it.

As the frustration grew, an aide joked in one meeting that White House staff should give fence-sitters the same colored leis so that the president and his Cabinet secretaries would know who to buttonhole. The desperation was such that others in the room paused for a split second to consider the joke before abandoning it as a logistical impossibility.

During the luau, Clyburn set up shop in the Oval Office with Obama to meet with wavering Democrats, like freshmen Reps. Frank Kratovil Jr. of Maryland and Eric Massa of New York. Members of Clyburn’s whip team patrolled the White House lawn, cornering colleagues and making the case for the bill.

As the week wore on, Pelosi was directing former Vice President Al Gore whom to call, but everyone decided late Wednesday night that the list of undecided members was small enough that he should stay in Nashville, Tenn., to make calls.

On the day of the vote, the bleary-eyed tag team of Pelosi and Clyburn camped out in the cloakroom, just off the House floor, for nearly three hours.

One of Pelosi’s first targets was Rep. Rush Holt (D-N.J.), a key fence-sitter who wanted more money generated from the carbon trading to be directed to the research and development of green technology.

Pelosi talked to him again and again, but he wouldn’t budge. Her message to him was the same as it was to others: It wasn’t worth voting against the bill because of what wasn’t in it.

According to witnesses, Pelosi perched herself on the arm of Holt’s chair and went nose to nose with him for a half-hour warning him that his no vote could scuttle the entire climate change effort — and that liberals would have another chance to make their case once the bill came back from the Senate.

Around 2 o’clock, he became a “yes.”

Next up was Austin, Texas, liberal Rep. Lloyd Doggett, who had seemed to be leaning toward the bill during a Thursday night visit with Obama in the Oval Office — but then infuriated the White House midday Friday by declaring the measure too weak on polluters to win his vote.

An exasperated White House staffer told POLITICO it was “stunning that he would ignore the wishes not just of his president but of his constituents and the country.”

Then Pelosi began working Doggett as the two stood in the back of the chamber near the railing, making the same perfect-is-enemy-of-the-good argument she had used against Holt. Doggett ended up voting “yes.”During the vote, Washington Rep. Jay Inslee, one of the taller members of the House, guarded the doors on the floor leading out to the Speaker’s Lobby, warning members not to leave the floor in case anyone needed to switch his or her vote. But that didn’t stop some Democrats, like Colorado Rep. John Salazar, from voting no early and sneaking out to avoid getting pressured by party leaders.

Leadership aides say Texas Rep. Ciro Rodriguez promised Pelosi he’d vote yes, but voted no and sprinted from the chamber. California Rep. Xavier Becerra tried unsuccessfully to flag him on his cell phone — and Rep. Anthony Weiner (D-N.Y.) bounded into the ornate Speaker’s Lobby off the floor shouting, “Rodriguez! Rodriguez!” as puzzled reporters looked on.

Pelosi forced members to postpone their trips abroad to stay in town for the vote, aides familiar with the situation said. At one point, she even promised to escort one member out to the airport in her motorcade to catch an early flight — as House Republican Leader John Boehner (R-Ohio) stalled the proceedings with an hourlong reading from the 300-page manager’s amendment.

California Rep. Ellen Tauscher, a master of floor procedure who left the House on Friday to take a top job at the State Department, may have made the biggest personal sacrifice by postponing a dinner the night before her wedding to preside over the debate — her last as a member of Congress.

When another Californian, Rep. Joe Baca, declared himself undeclared, Pelosi and her whip team surrounded him — and burst out into applause when he cast one of the decisive “yes” votes, according to an eyewitness.

Members who wanted to be spared of the Pelosi treatment — slinked in and out of the chamber hoping the speaker wouldn’t notice them.

Rep. Bob Filner (D-Calif.) — another progressive who didn’t think the bill was strong enough — was an especially elusive target, according to leadership aides. Pelosi’s attempts to contact Filner early Friday weren’t successful, staffers say, but she began lobbying him furiously when he showed up for a series of procedural votes leading up to the fateful climate change measure.

After Baca and others had cast their “yeas,” the speaker walked up to Filner and calmly said, “It’s now your time to be on the record, Mr. Filner,” according to a witness.

He voted yes.

BEIJING (AP) — U.S. House Speaker Nancy Pelosi urged Beijing on Thursday to cooperate on climate change, calling a safe environment a basic human right.

Speaking at Beijing's elite Tsinghua University, Pelosi continued the theme of her five-day China trip — that combating global warming represented a new challenge that both governments must tackle jointly.

"We are all in this together," Pelosi told an audience of about 200 students and faculty who applauded enthusiastically throughout the 45-minute session. "The impact of climate change is a tremendous risk to the security and well-being of our countries."

Pelosi's trip has been notable for skirting human rights and the fierce public criticisms she has frequently leveled at the authoritarian government.

The trip comes as President Barack Obama's administration has emphasized climate change as a new area where the two governments can broaden already wide-ranging engagement. The two countries are the biggest emitters of the carbon gases that are causing warming temperatures. Both governments are staking out positions ahead of a meeting late this year in Copenhagen that will try to forge agreement on targets and steps to reduce carbon emissions.

In a meeting Wednesday, the head of China's national legislature, Wu Bangguo, told Pelosi that climate change was a common challenge and that Beijing stood ready to work with Washington.

Turning around her usual criticisms about human rights, Pelosi linked global warming to environmental justice, saying the right to a clean environment is also a human right.

"I do see this opportunity for climate change to be ... a game-changer," she said at Tsinghua. "It's a place where human rights — looking out for the needs of the poor in terms of climate change and healthy environment — are a human right."

To achieve this, Pelosi said governments would have to make decisions and choices based on science.

"They also have to do it with openness, transparency and accountability to the people," she said. "Everyone has to have their situation improved by it."

In answering a question from a student about how Pelosi was going to get Americans to cut back on their carbon emissions, the leading Democratic lawmaker said it was important to educate children on how to conserve energy and for citizens to build more environmentally friendly homes.

"We have so much room for improvement," she said. "Every aspect of our lives must be subjected to an inventory ... of how we are taking responsibility."

Pelosi, who arrived Sunday, brought with her five members of a House committee on energy policy and global warming. A bill that would impose the first U.S. limits on greenhouse gas emissions was approved by a House committee last week, a step being considered by the full House later this year.

Pelosi's visit is part of a flurry of contacts between Washington and Beijing that highlight their wide-ranging cooperation on issues including North Korea's nuclear program and combatting the global economic slump.

Next week, U.S. Treasury Secretary Timothy Geithner travels to Beijing.

Here is what she said on KTVU-SF San Francisco:

"What they want is a continuation of the failed economic policies of President George Bush which got us in the situation we are in now. What we want is a new direction. This [tea party] initiative is funded by the high end we call call it astroturf, it's not really a grassroots movement. It's astroturf by some of the wealthiest people in America to keep the focus on tax cuts for the rich instead of for the great middle class."

This will be music to Republican ears. The GOP has already been mentioning Pelosi in their fundraising emails and now they can use her to capitalize on the Tea Party movement now that the parties are over.

Case in point: The National Republican Congressional Congressional Committee sent that quote out to its press list.

House Speaker Nancy Pelosi says she is on a mission to save the planet. She has consistently refused to allow a vote on drilling for oil because she says she believes it is all a hoax. But maybe Speaker Pelosi has other reasons.

The dcexaminer.com has recently revealed what that motive might be. The good Speaker owns stock in Clean Energy Fuels Corporation (CEFC). Have you ever heard of T. Boone Pickens? Yes, I’m referring to the Texas oil billionaire who is now promoting his new wind-power business on television. CEFC is T. Boone’s baby. This project will depend on federal subsidies and, don’t forget, high oil prices along with continued government restrictions on drilling for oil in the US.

Wind power may be useful, but it is not as reliable as the commercials paint it to be. This, however, is not my point. Does anyone else see a possible conflict of interest here? If gasoline prices remain high because Congress refuses to make drilling our number one economic priority, Pelosi stands to make substantial profits in the wind-power business. She is also in a position to help push federal subsidies toward CEFC. I wonder how many other national elected officials have invested in this deal along with Al Gore’s carbon credits? According to the dcexaminer.com:

“A search of Pelosi’s official web site found no announcement of the investment in the Pickens operation. A request to the Speaker’s official spokesman yesterday for information about the investment went unanswered. Coincidentally, Pelosi’s investment came the same month as the House passed the Honest Leadership and Open Government Act of 2007, which she hailed as making the Congress over which she helps preside “the most open and honest in history.” There are numerous ways Pelosi could provide assistance to . . . Pickens, including helping secure federal tax advantages. Pickens expects at least 15 percent profits on the wind farm and associated initiatives. At . . . $14 per share value, Pelosi appears to own between 7,000 and 17,000 shares.”

By the way, Pelosi and Pickens are already encountering opposition to their little business deal. Pelosi’s friends, the radical environmentalist groups around the country, are blocking both wind-power and solar-power production because they believe the wires carrying the electricity would disturb the beauty of the natural landscape and endanger some wild animals. Who would have thought?

This story has got to get legs. Republicans and Democrats alike would probably like to see Pelosi go. She is giving the Congress their lowest rating in years… lower than BUSH!

If corruption won’t do it, what will? There is nothing more devious than politicians who decide what legislation comes to the floor when they personally benefit from that legislation. It is a CRIME. Ask Duke Cunningham! Of course, he was a Republican.

Ok, so I’m a little late commenting on this article.
While I am not against alternative energies, there is one very critical piece that the liberals (Pelosi, et al) keep overlooking.
Homes do NOT run on solar or wind or thermal or horse-dung burning generators. Rather, homes can run on batteries. All of these “sources” of energy simply charge the batteries.
So what, you ask?
It takes several TONS of batteries to power your house. For 100 million homes across American (and that is a low estimate), it would take 100’s of tons of batteries. Lead batteries.
I thought we already had enough issues with “lead” in our homes, and landfills, and creeks, rivers, ocean fronts, etc.
And, keep in mind, these batteries only last 4-5 years.
So every 4-5 years we will be replacing and recycling 100’s of millions of tons of LEAD batteries all over this country.

Any idea on how much it costs to transport all those heavy batteries??

The congressman is collecting petitions that ask President Obama to "stop the immigration raids and deportations that are tearing our marriages, families and children apart." He is expected to present those petitions when Hispanic members of Congress meet with the President Wednesday.

On Saturday night, Pelosi joined Gutierrez before a cheering crowd at St. Anthony's chanting, "Si se puede," or "Yes we can."

Referring to work site enforcement actions by ICE agents, Pelosi said, "We have to have a change in policy and practice and again ... I can't say enough, the raids must end. The raids must end.

"You are special people. You're here on a Saturday night to take responsibility for our country's future. That makes you very, very patriotic."

"I was embarrassed by what she said," said Rick Oltman, with Californians for Population Stabilization, an anti-illegal immigrant group. "Exhorting illegal aliens for taking responsibility for our country's future.... In fact, sitting there in the audience.... I really resented that comment."

"I think it was pandering to the crowd but also insulting to American citizens who consider themselves to be patriotic, who obey the rule of law," said Oltman, who shot a video of the rally.

Perhaps if this broad loses her job to cheap labor illegal immigrant workers she'll change her mind. [W]ars cannot be run, at least not successfully, by committee, and one decision-maker is more accountable than hundreds of members of Congress. ...

The House's $124 billion Iraq spending bill -- a version of which is working its way through the Senate this week -- would violate the Constitution's separation of powers principle by interfering with the president's ability to exercise his powers as commander in chief.

The fact that the House bill also is larded with pork, including subsidies for such critical wartime industries as spinach growing and dairy farming, simply adds insult to injury. ... [T]he Democratic leadership must bribe its own members with new spending, or even -- as reported by The Politico -- threaten them with yanking the earmarks for their districts, to obtain enough votes for a raid on the president's constitutional authority. ...

As commander in chief, the president is entitled to make the strategic, operational and tactical decisions relating to combat ...

The House action, in addition to setting a firm deadline of Aug. 31, 2008, for the exit of all U.S. combat troops from Iraq, raises serious questions about how Congress can properly go about forcing the president to end the war. ...

[T]he United States finds itself today in a global struggle with an enemy who is entirely prepared to come to us as they did on Sept. 11, 2001. If Congress did block U.S. combat operations in Iraq, there is every reason to believe that it would quickly be transformed into a new al-Qaeda sanctuary. ...

[C]ongress appears willing to grant the power for the president to prosecute "counterterrorism" operations in Iraq, even while cutting off the funding for combat missions. ... [T]his language ... makes the problem even worse. It would amount to true congressional micromanagement ...

This type of militarily nonsensical splitting-the-difference compromise, of course, is a perfect example of war by committee -- and confirms the Framers' wisdom in vesting the power to direct America's armed forces in one individual, the president of the United States.

Iraq A lot of people think the 26 nations envolved with Iraq is not a worldwide effort. Let them know that in the Korean Conflict there were only 30 nations with troops envolved. 4 million Koreans were killed, 1 million Chinese and 400,000 Collition troops lost thier lives. WASHINGTON — House Democrats called for a new direction in Iraq on Friday, passing a measure ordering President Bush to withdraw U.S. combat troops from Iraq by September 2008.

Bush vowed to veto the measure if it makes it to his desk.

"A narrow majority in the House of Representatives abdicated its responsibility by passing a war spending bill that has no chance of becoming law and brings us no closer to getting our troops the resources they need to do their job," Bush said from the White House Diplomatic Reception Room while joined by family members of veterans and troops in combat.

Bush called on Congress to fund the troops, saying the current bill contains "too much pork, too many conditions."

"The purpose of the emergency war spending bill I requested was to provide our troops with vital funding. Instead, Democrats in the House, in an act of political theater, voted to substitute their judgment for that of our military commanders on the ground in Iraq."

High-ranked senators also vowed Friday to strip the language from the bill that requires troop withdrawal.

Democrats won passage by a 218-212 vote on the $124 billion war spending bill, which will fund the wars in Iraq and Afghanistan.

“Today, this Congress faces a historic vote. A vote to truly change the direction of the Iraqi conflict,” said Rep. Rahm Emanuel, D-Ill., just before the vote.

Rep. John Boehner, R-Ohio, also called the vote "historic," urging colleagues to vote against the measure.

"Our troops are on the ground in Iraq and Afghanistan, doing their duty to protect freedom and to end tyranny," House Minority Leader Boehner said. "They're there watching this debate we're having in the House today and wondering, 'Will Congress do its duty? Will Congress stand up and support he mission that I'm in?' "

The vote puts Congress closer to a showdown with the White House over Bush's Iraq policy.

Bush will veto the bill, White House spokesman Tony Snow told reporters at Friday's briefing.

"Look, the president's going to veto this bill, and he's going to veto it because even though it provides some funding, it also puts handcuffs on generals, colonels, lieutenant colonels, majors, captains, lieutenants, sergeants, corporals, privates, and everybody else," Snow said.

Most Republicans opposed the Democrats' plan, which also included budget requests not related to war spending.

"What we got instead was a poorly assembled wish list of non-emergency spending requests, wrapped in a date-certain declaration of defeat — a confirmation to our enemies that, if they hang on just a bit longer, we'll be out of their way soon," said Rep. Roy Blunt, R-Mo.

Rep. John Murtha, D-Pa., told fellow lawmakers a vote against the bill would be a vote against funding for the troops, health care and military families.

“You’re voting against supporting the troops if you’re voting against the money that goes to the troops,” Murtha said.

Bush urged Congress to approve the bill without a timeline during a meeting Thursday with his Iraqi civilian reconstruction team.

"The Congress owes you the money you need to do the job, without any strings attached," he said. "Congress needs to get their business done quickly, get the monies we've requested funded and let our folks on the ground do the job."

Defense Secretary Robert Gates warned that if Congress fails to pass a measure funding the war efforts by April 15, it will slow down training of troops scheduled for future deployments to Iraq and Afghanistan. Gates says it would also delay repair of equipment.

Meanwhile, the Senate Appropriations Committee on Thursday approved a $121 billion version of Bush's emergency war spending request, but bucked the White House by putting in language that sets a date-specific timeframe for withdrawing troops from Iraq.

The Senate bill sets a March 31, 2008, goal for withdrawing all combat troops out of Iraq. The legislation, which also gobs on billions in special projects at home, now heads to the Senate floor for a vote by the full chamber.

Sen. Robert Byrd, D-W.Va., issued a statement Friday chafing at the administration's veto threat. The Appropriations Committee chairman said the White House was ignoring homeland security problems and the needs of veterans and hurricane victims.

"The president continues to warn that we are a nation at grave risk of terrorist attacks, but he failed to request a single dime for homeland security priorities. The American people are sick and tired of Bush administration bellicosity. The White House ought to stop worrying about its political future, and instead should work with Congress to guarantee the security and economic future of this nation," Byrd said.

The full Senate likely will take up the bill next week, and a number of high-ranked senators said they aim to strip out the withdrawal language through an amendment they will offer Tuesday.

"We're not prepared to tell the enemy, 'Hang on, we'll give you a date when we're leaving.' We're not prepared to micromanage this new strategy ... and surge that's succeeding in Iraq. We're not ready to hamstring our military leaders and not let them carry their responsibilities," said Sen. John McCain, R-Ariz., who is co-sponosoring the amemdment.

Joining him, Sen. Joe Lieberman, D-Conn., said, "Deadliens set by Congress in war are deadlines for defeat." McCain and Lieberman were joined by Sens. Lindsay Graham, R-S.C., and Tom Coburn, R-Okla.

Senate Majority Leader Harry Reid's standalone measure to set a timeline for the withdrawal of troops failed last week by a 50-48 vote.

The House measure is unlikely to get through the Senate unchanged, where many Democrats oppose a timetable on the war.
